Terms of Service

These terms govern your use of Bunyan, a CRM and estimating platform for fence contractors operated by Diftar LLC (“we,” “us,” “Bunyan”). By creating an account or using the service, you agree to these terms. If you do not agree, do not use Bunyan.

You must be at least 18 years old and legally able to enter into contracts to use Bunyan. By using Bunyan on behalf of a company, you represent that you have the authority to bind that company to these terms.

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at privacy@bunyanbuild.com.

You may invite team members to your organization. You are responsible for your team members' use of Bunyan under your account.

Bunyan is a subscription-based tool for managing fence contracting operations, including customer management, estimating, proposals, invoicing, scheduling, and purchase orders. We provide the software as-is and continuously improve it.

Estimates are planning-grade. Material quantities are calculated from your measurements and fence type using standard construction practices. You should always verify final quantities and local pricing before ordering materials. Bunyan is a tool to help you estimate — it is not a substitute for professional judgment.

You own your data. All contacts, estimates, proposals, projects, invoices, catalogs, and other content you create in Bunyan belongs to you. We do not claim any ownership or intellectual property rights over your data.

You grant us a limited license to store, process, and display your data as needed to provide and improve the Bunyan service — including hosting, backup, analytics (in aggregate), security monitoring, customer support, and sharing with the third-party service providers listed in our Privacy Policy.

You can export your data at any time using the CSV export features built into Bunyan.

Bunyan is a paid subscription service. Plans start at $10/month (Starter) or $50/month (Pro) with annual billing discounts available. New accounts receive a 14-day free trial with full access. We are also building supplier partnerships to help contractors get better material prices.

If you use Bunyan's customer portal to collect payments from your customers, those payments are processed by Stripe. Stripe's standard processing fees apply. Bunyan does not charge additional fees on top of Stripe's rates.

Bunyan generates unique links for proposals and customer portals that can be accessed without logging in. You are responsible for sharing these links only with intended recipients. Anyone with a link can view the associated data. If you believe a link has been compromised, you can regenerate it from within the application.

You agree not to:

• Use Bunyan for any unlawful purpose
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile, or disassemble the Bunyan software
• Use automated tools to scrape data from Bunyan
• Interfere with or disrupt the service
• Upload malicious files or code

We reserve the right to suspend or terminate accounts that violate these terms.

We strive to keep Bunyan available and reliable, but we do not guarantee uninterrupted service. Bunyan is provided “as is” and “as available.” We may perform maintenance, deploy updates, or experience outages.

We are not liable for any losses resulting from service interruptions, including lost business opportunities or delayed estimates.

To the maximum extent permitted by law, Diftar LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Bunyan. This includes but is not limited to lost profits, lost data, business interruption, or inaccurate estimates.

Our total liability to you for any claim arising from these terms or your use of Bunyan is limited to the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Diftar LLC from any claims, damages, or expenses arising from your use of Bunyan, your violation of these terms, or your violation of any third-party rights.

You may stop using Bunyan at any time. We may suspend or terminate your account at any time for any reason, including violation of these terms. Upon termination, your right to use Bunyan ends. We will retain your data for 30 days after termination to allow you to export it, after which it will be deleted.

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these terms will be resolved in the courts of New York.

Bunyan is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, power outages, internet disruptions, government actions, pandemics, or third-party service outages.

Severability. If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full effect.

Waiver. Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment. You may not assign these terms without our consent. We may assign these terms in connection with a merger, acquisition, or sale of assets.

Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and Diftar LLC regarding Bunyan.

We may update these terms from time to time. If we make significant changes, we will notify you by email or through a notice in the application. Continued use of Bunyan after changes take effect constitutes acceptance of the updated terms.
